USCIS Further Expands Premium Processing for Certain Immigrant Petitions

USCIS has been incrementally expanding premium processing for certain petitioners who have a pending Immigrant Petition for Alien Workers (Form I-140), under the employment-based, first preference (EB1) and employment-based, second preference (EB2) classifications. The expansion applies only to certain previously filed Form I-140 petitions for multinational executive and manager (EB1C) classification or EB2 classification as a member of professions with advanced degrees or exceptional ability seeking a national interest waiver (NIW). Eligible petitioners who wish to request a premium processing “upgrade” must file with the appropriate USCIS service center a Request for Premium Processing Service (Form I-907) with a filing fee of $2,500. USCIS has 45 calendar days to process these upgraded I-140 petitions.

Beginning September 15, 2022, the agency is accepting premium processing upgrades for:

  • EB1C multinational executive and manager I-140 petitions received on or before January 1, 2022; and

  • NIW petitions received on or before February 1, 2022.

USCIS will reject premium processing requests for petitions filed after the dates listed above. The agency will not accept new (initial) Forms I-140 with a premium processing request at this time.
